Rental period

The rental period begins at the agreed-upon start time and ends at the agreed-upon end time. Late returns may result in additional fees.

Payment

A deposit is required to reserve a boat rental. The remaining balance is due at least 20 days before the start of the rental period.

Cancellation policy

Cancellations made within a certain time period may result in a cancellation fee. More than 60 days before rental period: 100 % refund. Less than 60 days before rental period: 80 % refund. Less than 20 days before rental period: no refund.

Boating license

For anyone born on or after January 1, 1988, who will be operating a boat in Florida waters with an engine of ten (10) horsepower or more, the law requires them to complete an approved boating safety course and obtain a Florida Boating Safety ID Card.

Boat operation

Only the renter and authorized passengers are allowed to operate the boat. The renter must be present on the boat at all times.

Safety equipment

The renter is responsible for any damage to the boat or equipment during the rental period. The renter is also responsible for returning it in the same condition as when it was rented. boating safety course and obtain a Florida Boating Safety ID Card.

Damage and cleaning

Yes, you are welcome to bring your own food and drinks on the boat. Please be sure to dispose of any trash properly.

Weather

The rental company reserves the right to cancel or reschedule a rental due to inclement weather or unsafe boating conditions.

Prohibited activities

The following activities are prohibited while operating the boat: drinking alcohol, using illegal substances, operating the boat while under the influence, and exceeding the boat’s maximum capacity.

Liability waiver

The renter will be required to sign a liability waiver before renting the boat.

If the boat is not available for whatever reason, owner will refund all payments made to tenant. No further compensation is due.


The boat will be delivered to the tenant with a full tank of gas and must be delivered to the owner with a full tank of gas. If the boat is not delivered to the owner with a full tank, we will charge a fee of $80 for refueling, plus the price of the required gasoline.


The owner receives a deposit from the tenant in the amount of $1,000. The deposit will be returned to the tenant within 3 business days after deducting any damages.


Navigation of boat is confined to inland and intercoastal waterways – not more than 5 miles offshore. Tenant must stay in marked channels. If tenant exceeds the defined areas the tenant will be required to pay the fees of Sea Tow should the boat become disabled in any manner. In this case the owner must be informed immediately. The boat cannot be taken out after darkness.


The tenant shall keep his/her copy of this agreement in his/her possession during the rental period.


Tenant who signs to accept the terms of this agreement certifies that he /she is born before Jan 1st, 1988.


Owner herein assumes no responsibility for weather conditions which may arise or occur during the term of this agreement, and all rates and agreements will continue in full force and effect until the return of the boat to the owner.


The boat shall be used exclusively as a pleasure vessel for the safe and proper use of the tenant, his family, and guests during the term of this agreement and shall not be used to transport merchandise, or passengers for hire or for pay. No towing of any kind with any rental boat is permitted.


Alcohol consumption by the tenant is strictly forbidden. The tenant agrees to operate the boat in a safe and legal matter as prescribed by all laws and regulations applicable to the area in which the boat is operated.


The tenant further agrees:

     a) To notify the owner immediately of any accident involving the boat. If alarm on boat or engine sounds, engine will be turned off 

          immediately and Owner will be contacted by cell phone.

     b) On demand, to reimburse the owner for the cost of all damages to the boat and equipment resulting from grounding, accident,

          collision, theft or loss.

     c) To release the owner and/or boat from any claim for loss and/or injury of any nature whatsoever which may occur during the period

          of this rental.

     d) To indemnify and save the owner and/or boat harmless from any claim for liability for loss and/or injury to any boat, property and

          persons, including all occupants of the boat hereby rented, by reason of accident involving the said boat during this rental as a result

          of the operation of the boat in violation of any law or ordinance.


Tenant acknowledges that it is unlawful for any person to fish from the boat without a fishing license. Tenant agrees that the use of the boat by a number of persons greater than the number of life jackets or buoyant cushions provided is prohibited (children 12 years of age and under are required to wear a life jacket at all times). Use of the boat to tow any other vessel or for water sports is illegal and shall result in the forfeiture of all security deposits. Tenant agrees to pay the owner the cost of replacing lost equipment and the cost of repairing damages to, and caused by, the boat including parts, labor expenses of transporting said vessel or other property to and from point of repair. All towing charges, including, but not limited to all towing charges as a result of grounding and beaching of the boat, and any collection cost and/or attorney fees necessary to secure reimbursement. It is understood, that the security deposit will be used for payment of all or part of the above cost up to its full amount. Cost in excess of the deposit shall be paid by the tenant to the owner on demand. Fuel used will be filled up or paid (extra fee $ 80) at the end of the rental period.


This contract constitutes the entire agreement by and between the parties hereto and no oral or implied agreement or understanding shall cancel or vary the terms of this contract unless reduced to writing and signed by the parties hereto. Boat shall be returned by the time agreed or an hourly charge of $50.00 for each additional hour or fraction thereof will be due.


Tenant agrees that he /she has read and understand ALL OF THE ABOVE THERMS AND CONDITIONS and agrees to indemnify Sun Island Boat Services LLC for all damages it sustains as a result of their violations by the tenant. The tenant agrees that he has understood all attached and specifically explained additional guidelines and instructions and agree to obey these.
